Can the Insurance Company Choose My QRC in Minnesota?

Picking a good QRC is essential for your work comp claim, don't get stuck with a bad one

Short answer: the insurer often tries to steer the QRC choice, but Minnesota workers have rights-and the details matter.

How QRC selection usually happens in real life

Scenario 1: The adjuster “assigns” a QRC

Commonly, the adjuster says something like:

“We’re assigning a QRC to help you.”

The QRC then calls you, schedules the rehab consult, and the process begins.

Scenario 2: The worker finds a QRC first

Sometimes the worker (or their attorney) contacts a QRC and asks for a consult.

Scenario 3: A doctor or clinic pushes rehab

A treating doctor may recommend vocational rehab, and then the insurer “sets it up.”

In all scenarios, the key issues are:

  • who is controlling the plan, and
  • whether the worker knows they can change QRCs (especially within the 60-day window after the plan is filed).

Disclosures: what you are allowed to ask about (and why)

Minnesota law requires certain disclosures at the first meeting about ownership/affiliations and financial interests related to the rehabilitation provider. (Minn. Stat. § 176.102, subd. 4.)

Practical takeaway: If you’re wondering “Is my QRC really neutral?”-ask:

  • “Who referred you?”
  • “Do you get most referrals from this insurer/TPA?”

If the answers are evasive, that itself is information.


What you can do if you don’t want the insurer’s QRC

If the rehab plan (R-2) has already been filed

You may have a limited period where changing QRCs is much easier:

  • within 60 days after the R‑2 is filed with DLI (Minn. Stat. § 176.102, subd. 4; Minn. R. 5220.0710).

This is why timing matters.

If rehab hasn’t been formalized yet

You may still be able to choose-but don’t just refuse contact. A poorly handled refusal can be spun as “noncooperation.”


What not to do

Don’t ghost your QRC

If you stop responding, your file can get closed for “noncooperation,” and now you’re fighting uphill. This can also cause your wage loss to be discontinued.

Don’t sign things you don’t understand

If you’re being asked to sign an R‑2 or R‑3 and you don’t understand the plan, ask for clarification in writing.

Don’t wait until the R‑8 arrives

By the time the plan closure notice shows up, you may have lost strategic time.


What to do instead

If you’re concerned you’re being steered, do this:

  1. Ask for the plan goal in writing.
  2. Ask what services will happen in the next 30 days.
  3. Document non-response or vague promises.
  4. If you’re within the 60-day window, consider switching QRCs cleanly and quickly.
